Abilene Trademark Report January 2021

Seven (7) trademark applications were filed in January with applicants listing an Abilene address.  The applications for goods included jewelry and accessories, hand sanitizer, toilet paper holders, and books. The applications for services included house painting, educational services, engineering services, and construction project management services. No trademarks were registered in January 2021 for applicants listing an Abilene residence.

Kat Von D Draws Infringement Suit

To prevail in this lawsuit against Kat Von D, the photographer will have to prove that the tattoo artist had access to the copyrighted Miles Davis portrait and copied it.  Based on this article, Kat Von D wasn’t hiding the copying.  I don’t know all of the facts, but there is probably some merit to this case.  A copyright owner has the exclusive right to reproduce the work, even if skin is the canvas.

Lubbock Trademark Report January 2021

Nine (9) trademark applications were filed in January by applicants listing a Lubbock, Texas address.  The applications for goods included clothing, magazines, and face masks. The applications for services included retail store services, lending services, broadcasting services, and hair salon services. In January 2021, fourteen (14) trademark applications were registered.  The registrations for goods included shaved ice, clothing, and DNA kits. The registrations for services included auto body repair, educational services, retail store services, and live airshow performances.


I’ve never been to Evermore Park where you can apparently watch ax throwing.  And according to my top 2020 songs list compiled by Spotify, I listened to a lot of Taylor Swift last year.  Anyway, Evermore Park is hurling its trademark infringement ax at T-Swift over the name of her Evermore album.  I don’t think anyone is going to be confused.        

Amarillo Trademark Report January 2021

Ten (10) trademark applications were filed in January by applicants with an Amarillo address. The trademark applications for products included craft kits, alcoholic cocktails, clothing, and beverage containers. The trademark applications for services included restaurant services, barber shop services, and financial exchange services. Ten (10) trademark applications made it to registration in January 2021. The registrations were for a variety of goods and services including credit union services, employee benefit plans, ministry services, installation services, auction services, and medical claims management.
