Midland/Odessa Trademark Report – February 2021

Fourteen trademark applications were filed by applicants with addresses in Midland or Odessa in February 2021.  Trademark applications for products included kennels, downloadable software, stickers, clothing, tools, and kitchen accessories. Trademark applications for services included software services, farming services, hair salon services, and bull-riding association services. In February 2021, only one trademark application was registered. The registration was for clothing.

USPTO Patent News

For years the U.S. Patent & Trademark Office has taken a hardline approach and rejected trademarks for products containing cannabis.  The government’s position has been that the products are illegal.  With changing marijuana laws, and perhaps a new administration, I’d expect to see the government soften its position, and ultimately, reverse course.  In perhaps a sign of the times, the Patent Office recently allowed a patent for a psychedelic containing cannabinoids.   https://www.prnewswire.com/news-releases/patent-combining-psychedelics-with-cannabinoids-allowed-by-uspto-301226012.html

Lubbock Trademark Report – February 2021

A whopping twenty-three (23) trademark applications were filed by applicants with a Lubbock address in February.  The trademark applications for products included drinkware, cotton, software, clothing, an imaging apparatus for small animals, blankets, furniture, trees, and pharmaceuticals.  Trademarks filed for services included warehousing services, retail store services, accounting services, auto body repair services, consulting services, computer security services, sporting entertainment services, marketing services, recruiting services, catering services, and educational services. Two trademarks were registered in February 2021 for backpacks and surgical services.

Amarillo Trademark Report – February 2021

Nine trademark applications were filed by applicants with an address in Amarillo in February 2021. The trademark applications for goods included tea, water, clothing, beauty supplies and modular systems. Trademark applications for services included safety training, consulting services, and indexing of commodities. Two trademarks were registered in February 2021 for hair salons and custom imprinting.

Abilene Trademark Report January 2021

Seven (7) trademark applications were filed in January with applicants listing an Abilene address.  The applications for goods included jewelry and accessories, hand sanitizer, toilet paper holders, and books. The applications for services included house painting, educational services, engineering services, and construction project management services. No trademarks were registered in January 2021 for applicants listing an Abilene residence.

Kat Von D Draws Infringement Suit

To prevail in this lawsuit against Kat Von D, the photographer will have to prove that the tattoo artist had access to the copyrighted Miles Davis portrait and copied it.  Based on this article, Kat Von D wasn’t hiding the copying.  I don’t know all of the facts, but there is probably some merit to this case.  A copyright owner has the exclusive right to reproduce the work, even if skin is the canvas. https://www.msn.com/en-us/music/news/kat-von-ds-miles-davis-tattoo-draws-copyright-infringement-suit/ar-BB1dxZ7I

In January 2021, fourteen (14) trademark applications were registered.  The registrations for goods included shaved ice, clothing, and DNA kits. The registrations for services included auto body repair, educational services, retail store services, and live airshow performances.
